As of January 1, 2013, the Ohio Residential Property Disclosure form has changed. This change affects most residential properties listed for sale in Ohio. Properties listed in 2012 which are still for sale in 2013 have the option to use the new form. Is Notification Required When Multiple Offers Are Received?

 There is nothing in license law requiring such disclosure. The Listing Agent should explain to their Seller the potential scenarios of disclosing multiple offers though. Normally, it is a good idea to let other agents know when they are in a multiple because typically it will cause the Buyers to put forth their highest and best offer. However, sometimes when a Buyer is informed that they are in a multiple, the Buyer may not want to get into a “bidding war” and may decide to pull their offer or may decide not to write an offer at all. When multiple offers are received, the Seller should decide which offer they want to work with and either accept or counter that one offer. Senate Passes Flood Insurance Bill

The Senate passed a flood insurance bill that will keep flood insurance hikes in check. The Flood Insurance Bill will be put in place for both residential and commercial properties. The bill will limit premium increases to 18 percent annually on newer properties and 25 percent for some older properties. There will also be a small assessment on policies until everyone is paying full cost for flood insurance. Proponents against the bill suggest that the rich homeowners along the coast are taking advantage of the rest of the country but there are many people that live along the rivers, streams and lakes that will be affected. http://www.realestateresource.tv

Can You Represent A Buyer On A Property You Used To Have Listed?

Yes, you can represent a buyer in the purchase of a property you had listed.  The Listing Agent will represent the Seller.  You still have fiduciary duty to the Seller. Fiduciary duty would be anything confidential between you and the Seller needs to remain confidential. If the Seller told you what they would accept for the property, you cannot disclose this unless the Seller told you it is alright to tell your Buyer. Ohio Broker Found Liable For Failing To Disclose A Negative Inspection

When in doubt we are always told to disclose! A Realtor acting as a Dual Agent fails to provide Home Inspection report from previous buyer. When a Seller of a property accepts an offer and the Buyer does an inspection and provides the inspection to the Seller or summarizes the issues from the inspection, the Seller and the agent have the responsibility to share this with the next Buyer if the deal with the first Buyer does not come to fruition. When an agent knows something about a property that is not disclosed it is their duty to make sure it is disclosed. If the Seller does not want to disclose then the agent should not keep the listing. It is the agents duty to advise the Seller to disclose the issues. It is not for the Seller to ask if it should be disclosed. Does An Inducement Need To Be Disclosed?

An inducement to a contract that causes a buyer and seller to enter into a contract must be disclosed. A Commission reduction from the listing agent, selling agent or both needs to be in the contract. The amount does not have to be but it is good to put it in so there is no discrepancy in regard to the amount. If a Home Warranty is offered by either listing or selling agent, it needs to be in the contract. What Does Ohio Law Require When A Licensee Becomes A Buyer Or Seller?

When a Licensee becomes a Buyer or Seller they cannot be a Dual Agent in the transaction. When listing a property the licensee if they decide they would like to purchase the home they have listed cannot represent the Seller and themselves in the transaction. The Seller may appoint another agent in the brokerage to represent them or the licensee may refer another agent in the brokerage and the licensee would represent themselves.When a Licensee becomes a Buyer or Seller they cannot be a Dual Agent in the transaction. When listing a property the licensee if they decide they would like to purchase the home they have listed cannot represent the Seller and themselves in the transaction. I live in Quail Hollow and love where I live! I get up in the morning and head to the club for a work out. The Golf Club has a workout room, showers, and Pro Shop!  It is like living at a Hotel. The advantages of a Lease Purchase Agreement are that the terms are agreed upon up front between the Seller and the Buyer.
The Buyer has the advantage that the Seller is a Landlord and has to comply with the Landlord Tenant Act, which includes making repairs to the property. The other advantage to the buyer is that if the property were to increase in value the Seller is contractually obligated to sell at the price agreed upon, while the buyer could sell to someone else at a higher sales price. The buyer may also have a portion of their rent go towards their down payment. The listing agent has a duty of disclosure when it comes to a negative home inspection report. If a property comes back on the market due to a negative home inspection report the seller needs to disclose the issues. The Seller does not have to provide the home inspection report to the next buyer but does have the duty to update their property disclosure. If the home inspection report is in the listing agent’s possession and the next buyer asks for a copy, it can only be given if Seller agrees to have the listing agent provide it. The Seller, if they do not agree with the inspection findings should have a their own professional inspector perform a home inspection and provide it to the next buyer along with the findings from the first buyer’s inspection.
