Ohio Broker Found Liable For Failing To Disclose A Negative Inspection

When in doubt we are always told to disclose! A Realtor acting as a Dual Agent fails to provide Home Inspection report from previous buyer. When a Seller of a property accepts an offer and the Buyer does an inspection and provides the inspection to the Seller or summarizes the issues from the inspection, the Seller and the agent have the responsibility to share this with the next Buyer if the deal with the first Buyer does not come to fruition. When an agent knows something about a property that is not disclosed it is their duty to make sure it is disclosed. If the Seller does not want to disclose then the agent should not keep the listing. It is the agents duty to advise the Seller to disclose the issues. It is not for the Seller to ask if it should be disclosed.
